Terms of Service

These Terms of Service ("Terms") govern your access to and use of the MacroFuel AI mobile application (the "App"), operated by Twin Apex Solutions, LLC ("we," "us," or "our"). By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.

1. Eligibility

You must be at least 13 years old to create an account and use the App. By using the App, you represent and warrant that you meet this age requirement. Users between 13 and 18 must have parental or guardian consent to use the App.

2. Account Registration

• You must provide accurate, complete, and current information when creating your account.
• You are responsible for maintaining the confidentiality of your login credentials.
• You are responsible for all activity that occurs under your account.
• You must notify us immediately if you suspect unauthorized access to your account.
• We reserve the right to suspend or terminate accounts that violate these Terms.

3. Subscriptions and Payments

3.1 Free and Premium Tiers

MacroFuel AI offers both free and premium ("Elite") features. Certain features, including but not limited to AI coaching, AI search assistant, advanced analytics, and community features, require an active Elite subscription.

3.2 Subscription Plans

• Monthly Plan: $7.99 per month, billed monthly
• Annual Plan: $49.99 per year, billed annually (includes a free trial period where applicable)

3.3 Payment Processing

Payments are processed securely through Stripe (web), Apple App Store (iOS), or Google Play (Android) via RevenueCat. By subscribing, you agree to the terms of the respective payment platform. We do not store your credit card information on our servers.

3.4 Billing and Renewal

• Subscriptions automatically renew at the end of each billing period unless cancelled before the renewal date.
• You will be charged the applicable subscription fee at the beginning of each billing cycle.
• Price changes will be communicated in advance and will apply at the next billing cycle.

3.5 Cancellation

• You may cancel your subscription at any time through the App, your device's subscription settings (iOS/Android), or by contacting us.
• Cancellation takes effect at the end of the current billing period — you will retain access to premium features until then.
• No partial refunds are provided for unused portions of a billing period.

3.6 Refunds

Refund requests are handled on a case-by-case basis. To request a refund, contact us at Macrologpro@gmail.com within 14 days of the charge. Refunds for app store purchases (Google Play, Apple App Store) are subject to the respective store's refund policies.

4. Acceptable Use

When using the App, you agree not to:

• Use the App for any unlawful or fraudulent purpose
• Post offensive, harmful, threatening, abusive, or harassing content in community Circles
• Impersonate another person or entity
• Upload malicious content, viruses, or harmful code
• Attempt to gain unauthorized access to other users' accounts or our systems
• Scrape, crawl, or use automated tools to extract data from the App
• Reverse engineer, decompile, or disassemble any portion of the App
• Use the App to promote or sell products or services without our permission
• Circumvent or attempt to circumvent subscription requirements for premium features
• Share your account credentials with others

5. Community Features (Circles)

5.1 User Content

• You retain ownership of content you post in Circles.
• By posting content, you grant us a non-exclusive, royalty-free, worldwide license to display your content within the App for the purpose of operating the community features.
• You are solely responsible for the content you post.

5.2 Content Moderation

• We reserve the right to remove any content that violates these Terms or that we deem inappropriate.
• We are not obligated to monitor all user content but may do so at our discretion.
• Repeated violations may result in account suspension or termination.

6. Health and Medical Disclaimer

• All nutritional data, macro calculations, calorie estimates, and AI-generated coaching insights are approximations only and may not be 100% accurate.
• AI-powered meal analysis provides estimated nutritional content based on text descriptions and images. Actual nutritional values may vary.
• The App should not be used as a substitute for professional medical advice, diagnosis, or treatment.
• Always consult a qualified healthcare professional before making significant changes to your diet, exercise routine, or health practices.
• If you have an eating disorder, a medical condition affected by diet, or are pregnant or nursing, consult your healthcare provider before using this App.
• We are not liable for any health outcomes resulting from the use of the App's recommendations or data.

7. AI-Generated Content Disclaimer

• MacroFuel AI uses Google Gemini AI to analyze meals, generate coaching advice, create grocery lists, and provide fitness insights.
• AI-generated content is provided "as is" and may contain inaccuracies, errors, or outdated information.
• You should independently verify any AI-generated nutritional data before relying on it for important dietary decisions.
• We do not guarantee the accuracy, completeness, or reliability of AI-generated content.

8. Intellectual Property

• The App, including its design, code, features, branding, logo, and content (excluding user-generated content), is the exclusive property of Twin Apex Solutions, LLC.
• The MacroFuel AI name and logo are trademarks of Twin Apex Solutions, LLC.
• You may not copy, modify, distribute, sell, or lease any part of the App without our written permission.
• All rights not expressly granted in these Terms are reserved.

9. Third-Party Services

The App integrates with third-party services. Your use of these services is subject to their respective terms:

• Google Gemini AI: Google Terms of Service
• Stripe: Stripe Services Agreement
• RevenueCat: RevenueCat Terms of Service
• Open Food Facts: Open Food Facts Terms
• Gmail (Google): Used for sending transactional emails such as password reset codes. Subject to Google Terms of Service.

We are not responsible for the practices, content, or availability of third-party services.

10. Food Verification System

• MacroFuel AI includes a crowdsourced food verification system where users can flag and correct nutritional data.
• User-submitted corrections are subject to review and may be approved or rejected at our discretion.
• Verified nutritional data is community-contributed and may still contain inaccuracies. See Section 6 above.

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR ACCURACY OF NUTRITIONAL DATA.

We do not warrant that the App will be uninterrupted, error-free, or free of harmful components.

13. Indemnification

You agree to indemnify and hold harmless Twin Apex Solutions, LLC, its officers, directors, and employees from any claims, liabilities, damages, losses, or expenses (including attorney's fees) arising from your use of the App, violation of these Terms, or infringement of any third-party rights.

14. Account Termination

• You may delete your account at any time by contacting us.
• We may suspend or terminate your account at our discretion if you violate these Terms.
• Upon termination, your right to use the App ceases immediately.
• Provisions that by their nature should survive termination (including liability limitations, disclaimers, and indemnification) will survive.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States. Any disputes arising from these Terms or your use of the App shall be resolved through binding arbitration or in the courts of competent jurisdiction.

16. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated by updating the "Last Updated" date and, where appropriate, notifying you through the App. Your continued use of the App after changes are posted constitutes acceptance of the revised Terms.

17. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

18. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Twin Apex Solutions, LLC regarding the use of the App.
